Rental contract / User agreement

 

Between the „owner“	Customer Journey Ventures GmbH / LOADIES® represented by Alexander Schleußner Wilhelm-Leuschner-Straße 19 55218 Ingelheim
and the „renter“	Data specified in the booking confirmation

the following rental contract is concluded:

 

Note: For reasons of better readability, the simultaneous use of the language forms male, female and diverse (m/f/d) is dispensed with. All personal designations apply equally to all genders.

 

• Rental object

The object of the rental contract is the rental of a LOADIES® power station with a capacity of 530Wh (useable energy content may vary depending on use). The condition of the rented objects is used.

 

• Intended use

The renter uses the rented object exclusively for the following private purpose: own power supply of private objects on the camping site of the festival specified in the booking confirmation. The rented object may, unless otherwise expressly agreed in writing, be used by the renter exclusively for the designated purpose. It must be used and operated in accordance with the legal regulations. The renter is liable for damages, penalties, fines or other impairments incurred by the owner as a result of improper or unlawful use of the rented object.

 

• Rental price

The rental price is deposited in the online store of LOADIES® under the respective festival (www.loadies-festivals.com). Further recharges within the agreed rental period are free of charge and not limited. The owner reserves the right to refuse a further free recharge. In addition, a valid official photo ID must be presented again. Recharging takes place at the owner's stand. The rental price must be paid in advance. The renter is not authorized to charge the power station himself.

 

• Duties of the renter
  • For identification purposes, the renter must present a valid official photo ID to the owner before handing over the rental object. In addition, a photo will be taken of this, which will be deleted at the end of the contract period (e.g. identity card or driver's license). Business cards or similar documents are not accepted as identification, as reliable proof of the residential address must be provided. The owner may require the deposit of an appropriate security for the duration of the rental period (e.g. car keys, photo ID, etc.).

 

• The renter undertakes to handle the rental object with care, in particular to observe the instructions for the proper use of the rental object (instructions for use, warnings, ), insofar as these are provided by the owner, and to use the rental object only in accordance with these instructions. In the event of any ambiguity, the renter must contact the owner for information on the proper use of the rental object before commissioning or using it.

 

• The renter is liable to the owner for damage to the rental object caused by a culpable breach of the duties of care and diligence incumbent upon him:
  1. Defect power station, self-inflicted: €250,00 per device, e.g.: water damage (moisture indicator red) or visible damage.
  2. Theft power station: Current new price (currently €500,00) of the product of LOADIES®. The renter is not responsible for changes or deterioration of the rental object caused by use in accordance with the contract (e.g. wearing parts).
  3. Optional: Cable lock with numerical code; defect: €10,00, theft: €20,00.

 

• Defects of the rental object occurring during the rental period may only be repaired by the owner or a person authorized by him. The renter must notify the owner immediately of any defect in the rental object. If no notification is made, the renter must compensate the owner for the resulting damage. If the owner is unable to remedy the defect for this reason, the owner will not be liable for any damage caused to the rental object or other property as a result of the defect.

 

• The renter is obliged to return the rental object to the owner at the end of the rental period in the condition in which it was received from the owner. The return to the owner has to take place at the following location: LOADIES® festival stand. If the renter does not return the rental object on time, the owner can demand 100% of the rental price as compensation for the duration of the withholding. The assertion of further claims for damages remains unaffected by this.

 

• Duties of the owner

The owner undertakes to provide the rental object to the renter for the specified period in a condition suitable for use in accordance with the contract above-mentioned use. The owner is liable in cases of intent or gross negligence in accordance with the statutory provisions.

 

• Term of the contract

The contract is fixed for the period specified in the booking confirmation and may not be terminated by either party before the end of the period. The right to terminate the contract for good cause remains unaffected.

 

• Severability clause

The invalidity of one of the above provisions will not affect the validity of the rest of the contract. The invalid provision shall be replaced by a provision that comes closest to the invalid provision from an economic point of view.
